Legal Basis
RA 7942 (Philippine Mining Act of 1995) and DAO 2010-21, aligned with AmBisyon Natin 2040, the 2030 Agenda for Sustainable Development (UN Resolution 70/1), the Philippine Development Plan 2023-2028, the National Climate Change Action Plan, and the Kunming-Montreal Global Biodiversity Framework.
SECTION 3. Scope and Coverage
All mining contractors, permit holders, and mining patent holders, for the SDMP required from Declaration of Mining Project Feasibility approval through development, construction, and operation.
SECTION 4. Key Definitions
- Host communities: stakeholders in the barangays within the Direct Impact Area under PD 1586 and DAO 2003-30, including IPs/ICCs and vulnerable sectors.
- Neighboring communities: barangays in the Indirect Impact Area.
- SDMP: the five-year community development plan of an operating contractor or permit holder.
SECTION 5. SDG Integration
SDMPs are prepared in consultation with host and neighboring communities and aligned with local and national development plans. Programs remain guided by Section 135 of DAO 2010-21 and must also align with the PDP, NCCAP, KMGBF, Section 8 of DAO 2022-04 (biodiversity in mining), and DAO 2021-22 (climate change mainstreaming). Fifteen SDGs are identified for the mining industry: Goals 1 to 11, 13, 14, 15, and 17 (excluding Goals 12 and 16). Annex 1 provides indicators and suggested projects per SDG. Operators sharing the same host communities may implement collective programs, subject to MGB Regional Office approval.
SECTION 6. Monitoring and Evaluation
Operators gather baseline data on host and neighboring communities and fund SDG capacity building. The MGB Regional Office checks SDG alignment against Philippine SDG indicators and advises on priority SDGs.
SECTION 7. Reporting
Operators include SDG progress in the annual SDMP accomplishment report and the Socio-economic/Social Impact Assessment, copy furnished to LGUs under DILG-NEDA JMC No. 01, s. 2018. MGB Regional Offices submit a consolidated SDMP-SDG report (Annex 2 form) to MGB Central Office within 60 days after year-end and may recommend expanding SDMP coverage to non-mining communities. MGB Central Office reports annually to the DENR Secretary.
Capacity Building, Transition, and Effectivity
MGB Central Office conducts and funds capacity building. Holders of approved SDMPs incorporate compliance in the next annual SDMP planning cycle and in the conduct of the SIA. The Order takes effect fifteen (15) days after publication and upon acknowledgement by ONAR.
