Permit to Operate (PTO) in the Philippines: Complete Guide & FAQ

The Permit to Operate (PTO) is a mandatory authorization issued by the DENR-Environmental Management Bureau (EMB) under Republic Act No. 8749 (Philippine Clean Air Act of 1999) that allows businesses to legally operate air pollution source installations such as generator sets, boilers, furnaces, and industrial equipment. Applications are processed through the Online Permitting and Monitoring System (OPMS) and require documentary submissions including an engineering report, plans and specifications, process flow diagrams, and an Environmental Compliance Certificate (ECC) or Certificate of Non-Coverage (CNC). A Regular PTO is valid for five years and must be renewed at least 30 days before expiration, while a Temporary PTO valid for 90 days is issued for new facilities requiring emission testing. Non-compliance carries severe consequences, including administrative fines of up to PHP 100,000 per day of violation and criminal penalties including imprisonment of six months to six years and fines ranging from PHP 50,000 to PHP 200,000.
