Overview of DENR Permits

Operating a business in the Philippines that has any interaction with the environment, whether through air emissions, wastewater discharge, waste generation, or land use, requires specific environmental permits from the Department of Environment and Natural Resources (DENR) through its Environmental Management Bureau (EMB).

The permit landscape can be confusing, especially for new businesses or those expanding operations. This guide provides a practical overview of the most common DENR environmental permits and how to determine which ones your business needs.

Environmental Compliance Certificate (ECC)

The ECC is the foundational environmental clearance under PD 1586. It certifies that your proposed project has undergone environmental impact assessment and that you have committed to implementing measures to prevent or mitigate negative environmental impacts. An ECC is required before project implementation for Environmentally Critical Projects and projects within Environmentally Critical Areas. The ECC application process requires either an EIS or IEE report prepared by a DENR-accredited EIS preparer.

Permit to Operate (PTO)

Under RA 8749 (Clean Air Act), any establishment that operates an air pollution source or air pollution control equipment must secure a Permit to Operate from the DENR-EMB. This includes boilers, generators, furnaces, incinerators, dust collectors, scrubbers, and any other equipment that emits air pollutants. The PTO must be renewed annually, and the establishment must demonstrate compliance with ambient and source emission standards.

Discharge Permit

Under RA 9275 (Clean Water Act), any establishment that discharges liquid waste (wastewater) into a water body or land must secure a Discharge Permit from the DENR-EMB. The permit specifies the allowable effluent quality standards and discharge volume. Establishments must regularly monitor their effluent quality and submit compliance reports. The Discharge Permit is renewed every five years with annual compliance verification.

Hazardous Waste Generator Registration

Under RA 6969 (Toxic Substances and Hazardous and Nuclear Wastes Control Act), establishments that generate hazardous wastes must register as Hazardous Waste Generators with the DENR-EMB. Registered generators must maintain a hazardous waste manifest system, store hazardous wastes properly in designated areas, contract only with DENR-registered hazardous waste transporters and treatment, storage, and disposal (TSD) facilities, and submit annual hazardous waste reports.

Certificate of Non-Coverage (CNC)

A CNC certifies that a project is not covered by the Philippine EIS System and therefore does not require an ECC. This is typically issued for small-scale projects with minimal environmental impact. The CNC application is simpler and faster than an ECC application, usually processed within 1 to 4 weeks.

Other DENR Permits

Tree Cutting Permit: Required for any cutting, gathering, or removal of trees, whether in forest lands or private lands (for certain species).

Water Permit: Issued by the National Water Resources Board (NWRB) for the appropriation of water from any source (surface water or groundwater).

Wildlife Gratuitous Permit or Wildlife Collector's Permit: Required for activities involving wildlife collection, research, or trade under RA 9147 (Wildlife Resources Conservation and Protection Act).

DENR Clearance for Foreshore Lease: Required for projects involving coastal areas and foreshore lands.

How to Determine What Your Business Needs

The permits your business needs depend on the nature and scale of your operations. Consider the following questions: Does your facility operate any fuel-burning equipment (generators, boilers, furnaces)? If yes, you likely need a PTO. Does your facility discharge wastewater to a water body or the sewerage system? If yes, you likely need a Discharge Permit. Does your facility generate hazardous wastes (used oil, chemical containers, electronic waste, medical waste)? If yes, you need Hazardous Waste Generator registration. Is your project a new construction, expansion, or modification of an existing facility? If yes, you may need an ECC or CNC. Are you clearing any trees or vegetation for your project? If yes, you may need a Tree Cutting Permit.

Many businesses require multiple permits simultaneously. For example, a manufacturing plant may need an ECC for the facility construction, a PTO for its boiler and generator, a Discharge Permit for its wastewater treatment plant, and Hazardous Waste Generator registration for its chemical wastes.

Consequences of Non-Compliance

Operating without required DENR permits exposes your business to fines and penalties under the applicable environmental law, Notices of Violation (NOV) and Cease and Desist Orders (CDO), criminal liability for responsible officers and directors, reputational damage and loss of business relationships, and inability to secure financing from banks and investors that require environmental compliance documentation.
