Legal Basis
Commonwealth Act No. 141 (Public Land Act), as amended; Executive Order No. 192; and Executive Order No. 292 (Administrative Code of 1987).
Scope
Lost or destroyed unregistered patents (not yet brought under PD 1529), whether or not already transmitted to the Registry of Deeds, provided verifiable records exist in LAMS or the records unit of the DENR field office.
Key Definitions
- Reconstitution: restoring the patent in the name of the original patentee exactly as it was.
- Revocation and reissuance: cancelling the lost or destroyed patent and issuing a new one to the heirs, assignee, or transferee.
Who May Apply
The patentee (or authorized representative) for reconstitution; heirs, assignees, or transferees of the original patentee for revocation and reissuance.
Requirements
- Application form (Annexes A-1 to A-3), Lot Status Clearance from the Land Registration Authority, valid ID, latest tax declaration or proof the lot is untitled, SPA if by representative.
- Fees: PHP 500 for reconstitution and PHP 500 for revocation and reissuance.
- Heirs: death certificate, PSA birth certificates, marriage certificate for surviving spouses, and an Affidavit of Heirship. Transferees: death certificate and the transfer document (deed of sale, assignment, donation, or waiver).
- DENR records prerequisite: a primary record (transmittal letter received by the Registry of Deeds, duplicate Order of Issuance, or onion-skin duplicate patent) or, failing that, a secondary record (lot index card, allocation book, inventory of judicial forms, or Registry of Deeds or PENRO logbook entries). Without records, the application is rejected, though the applicant may apply for a new patent.
Filing and Processing
Filed at the CENRO, Implementing PENRO, or DENR-NCR LPDD, personally, by email (PDF), or by courier, with SMS notifications through LAMS.
- Preliminary assessment within 3 working days.
- Acceptance, encoding, and upload to LAMS.
- Records verification within 3 working days.
- Order of Payment.
- Posting of Notice of Application for 15 calendar days at the municipal or city hall and barangay hall.
- For revocation and reissuance only: confirmatory investigation within 15 working days, with a report including a geotagged photo within another 15 working days.
- Order of Reconstitution or of Revocation and Reissuance by the PENRO or RED within 7 working days of recommendation (30 working days if the Secretary signs), cancelling the previous Order of Award.
- Issuance of the patent and transmittal to the Registry of Deeds within 5 (PENRO), 10 (RED), or 15 (Secretary) working days of approval.
Reconstituted patents keep the original number with an "R" suffix. Once reconstituted or reissued, the old patent, judicial form, and serial number are deemed revoked.
Effectivity
Takes effect fifteen (15) days after publication and upon filing with ONAR.
